Privacy Policy

1. Who we are

Aether Blue Associates Private Limited (“Aether Blue”, “we”, “us”, “our”) is a company incorporated in India, with its registered office at Near Jain Petrol Supply Company, Club Road, Hazaribagh 825301, Jharkhand, India.

We provide Employer of Record (EOR), PEO, payroll, HR compliance, accounting and management consultancy services, principally to clients outside India.

This Privacy Policy explains how we handle personal data collected through our website, aetherblueassociates.com.

2. Scope of this policy

This policy covers personal data we collect from visitors to our website and from persons who contact us about our services.

It does not cover personal data we process in our capacity as employer or service provider under a signed Master Service Agreement with a client — for example, the data of employees we engage on a client’s behalf. That processing is governed by the relevant employment contract, the client agreement and applicable Indian labour and tax law.

3. The personal data we collect

Information you give us directly. When you complete our contact or cost-sheet form, request a guide, or email or call us, we may collect your name, work email address, telephone number, company name, job title, country, expected headcount and roles, and anything else you choose to include in your message.

Information collected automatically. When you visit the website, our servers and analytics tools may record your IP address, browser type and version, device and operating system, referring page, pages viewed, time spent and approximate location derived from your IP address.

Cookies. See section 8 below.

We do not knowingly collect sensitive personal data through this website, and you should not submit it to us through the website. We do not collect personal data of children through this website.

4. Why we use it, and on what basis

We use personal data collected through this website to:

  • respond to your enquiry and prepare a cost sheet or proposal;
  • send you a document or guide you have requested;
  • communicate with you about our services during the course of a prospective or existing engagement;
  • maintain our business records and meet our legal, tax and accounting obligations in India;
  • operate, secure, maintain and improve the website.

Where the Digital Personal Data Protection Act, 2023 applies, we process your personal data on the basis of the consent you give when you voluntarily submit it to us for a specified purpose, and, where applicable, on the basis of the legitimate uses recognised under that Act. Where the law of another jurisdiction applies to you, we rely on the equivalent lawful basis available under that law — ordinarily your consent, our legitimate interest in responding to your enquiry, or steps taken at your request prior to entering into a contract.

We do not use your personal data for automated decision-making that produces legal effects concerning you.

5. Marketing

We may send you information about our services where you have asked us to, or where you have enquired about them. Every such message will carry a means of withdrawing your consent, and you can also write to us at any time at the address in section 11 to stop receiving them.

We do not sell personal data, and we do not share it with third parties for their own marketing.

6. Who we share it with

We share personal data only as follows:

  • Service providers who help us run our business — website hosting, email, analytics, cloud accounting and document storage — and who are permitted to process the data only on our instructions and for the purpose we specify;
  • Professional advisers — our chartered accountants, legal advisers, bankers and insurers — where necessary;
  • Authorities, where we are required to disclose by Indian law, by a court or by a regulator, or where disclosure is necessary to establish, exercise or defend a legal claim.

We do not sell, rent or trade personal data.

7. Transfers outside India

Our clients are largely outside India, and some of the service providers we use store data on servers outside India. Where personal data is transferred outside India, we do so in accordance with section 16 of the Digital Personal Data Protection Act, 2023, and we do not transfer personal data to any territory to which such transfer is restricted by the Central Government.

8. Cookies and analytics

The website uses cookies and similar technologies. These fall into two categories:

  • Necessary cookies, which are required for the website to function and to keep it secure;
  • Analytics cookies, which help us understand how the website is used so that we can improve it.

You can block or delete cookies through your browser settings. If you block necessary cookies, parts of the website may not work as intended.

9. How long we keep it

We keep enquiry data for as long as needed to deal with your enquiry and for a reasonable period afterwards in case you come back to us, and thereafter delete it or render it non-attributable.

Where an enquiry becomes an engagement, we retain the records for the period required by Indian company law, tax law and our own audit requirements. Website analytics data is retained in aggregated form.

10. Your rights

Subject to the conditions and exceptions in applicable law, you have the right to:

  • obtain a summary of the personal data we hold about you and how we process it;
  • have it corrected, completed or updated where it is inaccurate or incomplete;
  • have it erased, where it is no longer needed for the purpose for which it was collected and we are not required by law to retain it;
  • withdraw your consent at any time, as easily as you gave it — noting that withdrawal does not affect anything done on the basis of that consent before it was withdrawn, and may mean we can no longer deal with your enquiry;
  • nominate another person to exercise these rights on your behalf in the event of your death or incapacity;
  • have your grievance addressed through the route set out below.

To exercise any of these, write to the Grievance Officer at the address in section 11. We may need to verify your identity before acting on the request.

11. Grievance Officer and contact

12. Security

We apply reasonable technical and organisational safeguards to protect personal data against unauthorised access, alteration, disclosure or destruction, including transport encryption on our website, access controls and regular backups. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. Third-party websites

Our website may link to websites we do not control. We are not responsible for their content or their privacy practices, and this policy does not apply to them.
